- Who is my Underwriter?
Your underwriter is determined by where your agency is located and what type of policy you have. By using our "Guide Me To" tool on the right hand side of our website you can simply input your agency zip code to find your local underwriter who can guide you in the right direction and answer your questions.
- What Application should I complete?
Again, by using our "Guide Me To" tool you can find the application that fits your client or prospect. Still not sure? Use the tool to find your local underwriter and give them a call.
- How do I get Loss Runs?
To provide loss runs a written request from the insured is required. By faxing or emailing the request to your underwriter (see question #1 above) your request will be processed and loss runs forwarded to you. Please make sure to include the policy number and policy year(s) as appropriate as well to help expedite your request
- What are your billing/payment options?
On publicly traded and financial services business, premium is invoiced upon binding and due net in 30 days as outlined in the HFP addendum to your Hartford agency contract.
On privately held business we additionally offer direct bill through our Hartford TABS system. If your client also purchases commercial lines coverages on TABS from The Hartford all policies will be combined for billing purposes. Multiple payment options are offered, for specifics please contact your underwriter.
- What are your minimum premiums?
Minimum premiums vary by coverage and state. In most states, our minimum premium for Employment Practices Liability is $1,500 on Private Choice Encore!! D&O on Private Choice Encore!! has a $2,000 minimum premium in most states, however if your client purchases both their premium may be less than the two premiums combined. For specifics you should ask your underwriter.
- Can you provide Defense Outside the Limit of Liability?
On Private Choice Encore!! we can provide DOL for D&O, EPL and Fiduciary Liability. For D&O and EPL the defense outside limit is offered at 50% of the respective limit purchased, and for Fiduciary there are options for additional 50% and 100% defense outside limits. The cost is an additional 20% per coverage part for 50%.
- How are renewals handled?
At HFP we realize how important having a local underwriter knowledgeable about
management liability is to your agency. No service centers, no renewal underwriters,
your local underwriter and their assistant underwrite your new and renewal business.Our auto renewal system allows our underwriters to be away from their desk and in your office, while your least complex renewals are automatically processed and sent to you as renewal quotations. Have a question about a renewal, your local underwriter will be happy to sit with you, in your office, to talk about it
- Does commission change at renewal?
No. Our industry leading 17.5% on Private Choice Encore!! standard business applies to new and renewal business. This enhanced commission has been representative of Hartford's dedication to our agents' value added to management liability business for years.
- On Quick Quotes, can I bind subject to an application?
Our Quick Quote feature has been part of our website for over 5 years now. Agents tell us they love the ability to get a premium indication within 24 hours from their local underwriter with just a few basic pieces of information.
On the indication your underwriter will state what additional information is required to either (a) turn your indication into a firm quote or (b) bind the account. An application is required to bind coverage. Note that we are willing to accept certain competitor's applications, so if your client has already completed one application you may send that to us as well.
- Do you have a hammer clause?
A "hammer clause" or settlement clause, in general states that if an insured does not agree to a settlement offer that is acceptable to the plaintiff and insurance company, then the insured may be responsible for any additional defense and indemnity above the acceptable settlement offer. This is a critical coverage issues for private companies on personal coverages such as D&O and EPL, as the owner may want to fight litigation rather than risk tarnishing his/her local reputation.
Since our Private Choice form was introduced in 2002 we have not included a "hammer clause" in our basic policy form. As with any coverage question, please refer to your specific policy language for precise terms and conditions
- Is there a panel counsel list, or can the insured choose their own attorney?
While we do not employ a panel per se, on a duty to defend policy it is the right of the insurance company to select counsel. We are flexible on EPL coverage as respects utilizing counsel identified by the insured, subject to two very important conditions.
First, the discussion of utilization of counsel must happen at policy issuance and be endorsed onto the coverage form, including agreement of rates by such counsel.
Second, a simple questionnaire must be completed, reviewed and approved by our claims department to verify that such counsel has sufficient experience in employment litigation
- Does our 3rd Party Crime coverage extend to theft of data?
As with any coverage question please review the specific form or policy your client is purchasing or considering.
Our Encore!! Crime coverage section does not cover data due to the inability to determine the value around data lost. For an otherwise covered claim for theft of data, the value of the physical item stolen (cd's, laptops, etc) would be covered
- Do you offer coverage for non-profit organizations?
Yes we do. For over 8 years we have partnered with Aon Affinity Services of Washington, DC to offer non-profit D&O and EPL coverage for five specific industries in the non-profit market.

- Is there a list of target or excluded classes?
Unlike commercial insurance coverages, the underwriting appetite for management liability coverages rarely depend on the class of business. Rather, we seek out well-run financially strong firms who are aware of and properly address employment issues in the workplace.
We are not a market for Lawyers EPL, Auto dealers EPL, Medical Malpractice, or E&O for Architects and Engineers. Our MPL section of this website includes more specific appetite information for our E&O lines of business. For other specific appetite questions, please contact your underwriter.
- What is your limit capacity?
While the vast majority of our insureds purchase limits of $10,000,000 or less, we have the capacity to offer up to $25,000,000 on both a primary and excess basis.
- Do you have claims examples for private companies?
Yes we do. Our Create a Sales Kit section on the right hand side of the website enables you to enhance your insurance proposal by adding sales brochures and claims examples by coverage
- What type of risk management / loss control do you offer?
We provide two different opportunities for our clients to access risk management services free of charge.
First, at hartfordhelp.com our insureds can access up to date information on employment issues, laws and trends to assist their human resources efforts. This includes training programs for issues like sexual harassment and discrimination, all free of charge. For a demonstration of this website please contact your agent.
Second, we have partnered with national employment law firm Jackson-Lewis to offer risk management services for our insureds. This includes 4 free hours of consultation with an employment attorney, access to their employment law newsletter, and more.
